Important information about employee claims for workers' compensation
If you have been injured on the job, there are important aspects of workers' compensation that you need to know if you wish to file for benefits.
- You should report your injury to your employer as soon as possible, but not later than thirty days after the accident.
- Your employer must report the injury to state authorities and the insurance company no later than seven days after they learn of the accident.
- The insurance company must provide you with an informational brochure explaining your rights and responsibilities within three days after receiving notice from the employer.
Your employer or the insurance company will send you a list of authorized medical providers where you can receive medical treatment. All medical bills should be submitted by the medical provider to your employer's insurance company for payment.
If your workers' compensation is approved, you will receive a bi-weekly benefit check that is just over 66 percent of your average weekly wage. The amount is calculated by using wages earned in the 13 weeks prior to your injury, not counting the week in which you were injured. You should receive the check within the first 21 days after reporting your injury and, importantly, you do not have to pay income tax on the money that you receive.
